Abstract:
ÖZET: Bu çalışmayla güdülen amaç Kıbrıs Türk hukuk sisteminin oluşum,gelişim ve değişim sürecini incelemektir. Bu amaç çerçevesinde konuya tarihsel bir bakış açısıyla klaşılmış ve Osmanlı döneminden KKTC’ye kadar geçen evreler içinde Kıbrıs Türk Hukuku incelenmiştir. İnceleme sırasında özellikle birbirini izleyen siyasi yapılanmalar içinde yürürlüğe konulan mevzuat dikkate alınarak değerlendirilmiştir. Bu değerlendirme
sonunda Kıbrıs Türk hukuk sisteminin tarih içinde adaya egemen olan
güçlerin hukukunun etkisinde kaldığı ve güncel Kıbrıs Türk hukuk sistemini
etkileyen en önemli hukuk çevresinin Anglo-Sakson hukuku olduğu
vurgulanmış, ancak özellikle 1974’ten sonra sistemde yer alan maddi hukuk kurallarının giderek Türk hukukuna kaydığının altı çizilmiştir. This article aims to analyse the period of formation, development and change of the Turkish Cypriot legal system. In this regard, the subject is dealt from a historical perspective, analysing the Turkish Cypriot Law since the Ottoman era until TRNC. Throughout the analysis, respective acts of legislation put into force by succeeding political entities are assessed. At the end of this assessment it is concluded that the Turkish Cypriot legal system is affected by the laws of the ruling powers of the Island throughout history
and mainly by Anglo-American Law, however underlining the fact that since 1974 substantive rules of Turkish Cypriot Law correspond gradually the rules of Turkish Law.
