Türk Hukuku ve KKTC Hukuku’nda Ticaret Gemilerinin Türk Bayrağı Çekme Hakkı

Abstract

ÖZ: Günümüzde ticaret gemilerinin yaptığı seyrüsefer üzerinden ekonomik kazanç elde etme talebi artmıştır. Gerçek kişiler, tüzel kişiler ve donatma iştiraki gemi sahibi olarak yük ve yolcu taşımacılığından kazanç sağlamayı hedeflemektedirler. Özellikle yaşanan pandemi döneminden sonra ticaret gemilerinin seyrüseferlerine ticaretle uğraşan kişilerin yanında diğer kişilerin de ilgisi yoğun bir şekilde artmıştır. Ticaret gemilerinde çekili bulunan ve tabiiyeti gösteren bayrak, hukuki çerçevede önem taşımaktadır. Çünkü gemi her yönden bayrağını taşıdığı devletin kurallarına tabi olur. Yüksek lisans tez çalışmamızda Türkiye ve KKTC gemilerinin hangi koşullarda Türkiye ve KKTC Bayrağı çekme hakkını kazandıkları; Türk gemileri için, Türk Ticaret Kanunu ve Türk Uluslararası Gemi Sicili Kanunu çerçevesinde KKTC gemileri için 45/1963 sayılı Gemilerin Kaydı, Devri veya İntikali ile İpoteği ve Bunlara Mütedair Hususlar Hakkında Hüküm Koyan Yasa çerçevesinde hak sahibi olabilecek gerçek kişiler, tüzel kişiler ve donatma iştiraki açısından ortaya konulmuştur. Bayrak çekme hakkının kazanılmasından sonra kullanılması için de Türkiye ve KKTC’de kanunların ve/veya yasanın aradığı belgeler ispat külfeti açısından taşıdığı önemden dolayı detaylı bir şekilde belirtilmiş ve hakkın kazanılması, kullanılması ve kaybına dair koşullar arasındaki bağ ortaya konulmuştur

Today, the demand for economic gain through the navigation of merchant ships has increased. Real persons, legal entities and armament subsidiaries aim to profit from freight and passenger transportation as ship owners. Especially after the pandemic period, the interest of the citizens, after the traders, in the navigation of the merchant ships has increased intensely. Flag, which is hoisted on merchant ships and shows nationality, is important in the legal framework. Because the ship is subject to the rules of the state whose flag it carries in every way. In our master's thesis, how Turkey and TRNC ships gained the right to fly the Turkish and TRNC Flag; For Turkish ships, within the framework of the Turkish Commercial Code and the Turkish International Ship Registry Law, for TRNC ships, in terms of natural persons, legal entities and armament participation, which may be entitled within the framework of the Law No. has been revealed.
