| dc.description.abstract | This doctoral dissertation critically examines the principle of voluntary repatriation as a durable solution to refugee displacement in both the African and international protection contexts and addresses the complexities surrounding the ‘voluntariness’ of repatriation decisions, especially in the face of push factors influencing refugees’ choices and discussions surrounding the evolving concept of ‘home’. It traces the evolution of voluntary repatriation in the African system of refugee protection, arguing that it was introduced primarily to serve the security concerns of newly independent African states. Similarly, its evolution and crystallization under international refugee law as preeminent solution to refugee-related issues is questionable. By juxtaposing voluntary repatriation with co-constitutive principles of modern international society like asylum and non-refoulement, coupled with a critique of its socio-political origins and practice, the very necessity of voluntary repatriation as a solution is questioned. Adopting an interdisciplinary approach which combines the social process and legalization theories, fragmentation applied as an analytical framework, and the concept of primary institutions of international society from international law, and threat framing from international relations, is utilized to critique voluntary repatriation as a ‘durable solution’ to refugee displacement. The findings have important implications for refugees, policymakers and practitioners working in the field of refugee protection and resettlement. | dc.description.abstract | Bu doktora tezi, Afrika ve uluslararası koruma kontekstlerinde mültecilerin yerinden edilmesine uzun süreli bir çözüm olarak gönüllü geri dönüş ilkesine eleştirel bir bakış sunmakta ve mültecilerin kararlarını etkileyen itici faktörler karşısında ülkesine geri dönüş kararlarının ‘gönüllülüğü’ etrafındaki karmaşıklıklara değinmekte; özellikle ‘ev’ kavramının değişimi etrafındaki tartışmaları ele almaktadır. Afrika mülteci koruma sisteminde gönüllü geri dönüşün evrimini izleyerek, bunun başlangıçta yeni bağımsız Afrika devletlerinin güvenlik kaygılarına hizmet etmek için öncelikle ortaya atıldığını tartışmaktadır. Benzer şekilde, uluslararası mülteci hukuku altında gönüllü geri dönüşün mülteciler ile ilgili sorunların üstesinden gelinmesi için öncelikli çözüm olarak görülmesinin evrimi ve zaman içinde billurlaşması sorgulanmaktadır. Gönüllü geri dönüşü modern uluslararası toplumun diğer oluşturucu prensipleri olan sığınma ve non-refoulement (geri göndermeme) ilkeleriyle yan yana getirerek, sosyo-politik kökenleri ve uygulamaları eleştirilirken, gönüllü geri dönüşün bir çözüm olarak gerekliliği sorgulanmaktadır. Sosyal süreç ve yasallaştırma kuramlarını birleştiren, analitik bir çerçeve olarak parçalanma kuramını ve uluslararası toplumun temel kurumları kavramını uluslararası hukuktan, uluslararası ilişkilerden tehdit çerçevesini birleştiren disiplinlerarası bir yaklaşım kullanılarak, gönüllü geri dönüşün mülteci yerinden edilmesine karşı bir ‘kalıcı çözüm’ olarak eleştirilmesi değerlendirilmiştir. Bulgular, mülteciler, politika yapıcılar ve mülteci koruma ve yerleştirme alanında çalışan uygulayıcılar için önemli sonuçlar doğurmaktadır.
