Kuzey Kıbrıs Türk Cumhuriyeti'nde İdari Sözleşmeler, Sona Erme Halleri ve Çıkan Uyuşmazlıkların Çözümü

Abstract

ö z: îdare hukukunun en önemli konularından birini oluşturan idari sözleşmeler, bu sözleşmelerin sonlandırılması ve çıkan uyuşmazlıkların çözümü konusunun idare hukuku alanında iyi anlaşılması ve sözleşmelerin niteliğinin doğru belirlenmesi son derecede Önemlidir. Bu nedenle çalışmamızın temel amacı, ülkemizde ve Türk idare hukukunda önemli yere sahip olan ve gelişen süreç içerisinde uygulama alanının oldukça genişlediği idari sözleşmeler, bu sözleşmelerin sona erme halleri ve doğan uyuşmazlıkların çözüm yollarının açıklanmasıdır. Bu kapsamda KKTC’de idari sözleşmeler, sona erme halleri ve çıkan uyuşmazlıkların çözümü isimli çalışmamız iki bölümden oluşmaktadır. Birinci bölümde idarenin sözleşmeleri, sözleşme kavramı, idarenin özel hukuk sözleşmeleri, idari sözleşmeler, idari sözleşme kriterleri, idari sözleşmelerin türleri, ikinci bölümde ise idari sözleşmelerin sona erme halleri ve idari sözleşmelerden kaynaklanan uyuşmazlıkların çözüm yolları açıklanmaya çalışılmıştır. Tezde, konumuz hakkında doktrinde ileri sürülen ve kabul gören genel görüşler yanında karşıt görüşler ve tartışmalar aktarılmaya çalışılmış ve bu görüşler yanında TC Danıştay, Anayasa Mahkemesi, Uyuşmazlık Mahkemesi kararları ve KKTC Yüksek Mahkeme ve Yüksek İdare Mahkemesi kararlarına ayrıca değinilmiş, bu kararlardan çeşitli örnekler verilerek konumuz açıklanmaya çalışılmıştır. Administrative contracts which constitute one of the most important issues of administrative law, the finalization of these contracts and the correct understanding of the solution of the disputes in the field of administrative law and the determination of the nature of contracts are finally important. For this reason, the main aim of our work is the administrative contracts which have a significant place in our country and in the Turkish administrative law and whose scope of application has widened considerably in the developing process, explaining the ending states of these contracts and the solutions of the disputes that arise. In this context, the administrative contracts in the TRNC consist of two parts: the cases of ending and the resolution of the disputes that we do not work named. In the first part, the solutions of conflicts arising from administrative agreements, concept of contract, private legal contracts of administration, administrative contracts, administrative contract criteria, types of administrative contracts and the second part of administrative contracts and administrative contracts were tried to be explained. In the thesis, besides the general opinions suggested and accepted in the doctrine about the position, the opposing views and discussions were tried to be mentioned and besides these opinions were referred to the TC Council of State, the Constitutional Court, the decisions of the Dispute Court and the decisions of the Supreme Court and High Administrative Court of TRNC tried to explain.
