KKTC Ceza Hukukunda Meşru Müdafaa

Abstract

Self-defense institution in Turkish Republic of Northern Cyprus which has a very old history in criminal law constitutes the topic of the present study. With this respect, in Turkish Republic of Northern Cyprus where the common law foundation of self-defense is in practice, historical developments and conditions will be explained through the samples of decisions made on this topic. At the same time, mistakes related to self-defense in case of exceeding the limits, how self-defense will be applied and the necessity of self-defense institution, and its relation with unjust provocation will be examined. The aim of the present study is to explore this controversial topic throughly and to evaluate the decisions made with this respect in the axis of Turkish Republic of Northern Cyprus court.

ÖZET: Çok eski bir geçmişe sahip olan meşru müdafaa kurumunun, KKTC ceza hukukundaki yeri, bu çalışmanın konusunu oluşturmaktadır. Bu kapsamda, ortak hukukun uygulandığı KKTC’de meşru müdafaanın hukuki esası, tarihsel gelişimi, koşulları, bu konuyla ilgili verilmiş kararlarla örneklendirilerek anlatılmaya çalışılacaktır. Aynı zamanda, meşru müdafaada hata, sınırın aşılması durumunda, meşru müdafaanın ne şekilde uygulanacağı ile bu kurumun zorunluluk hali ve haksız tahrikle ilişkisi de incelenecektir. Çalışmanın amacı, çok tartışılan bu kurumu bütün yönleriyle incelemek ve KKTC mahkemeleri tarafından verilen kararları bu eksende değerlendirmektir.
